NOTICE OF HEARING

June 16, 2008

TO:    All License Applicants for Live Racing and Off Track Betting Facilities

FROM :    Henry W. Jackson, Executive Director

RE:   Request to re-open the 2008 Assignment of Race Date Hearing.

On June 25, 2008 at 12:30 PM in the Gambling Control Board Conference Room, Department of Public Safety Building, 45 Commerce Drive, Augusta, Maine, the Maine Harness Racing Commission will hold a hearing pursuant to 8 M.R.S.A. §§ 271, 275-D and 275-N and Commission Rule, Chapter 19, Section 4. The purpose of the hearing is to take testimony relative to a request from Penn National Gaming, Inc. d/b/a Bangor Raceway to re-open the 2008 Race Date Assignment Hearing. Penn National Gaming, Inc. is requesting fifteen (15) additional dates, July 1, 8, and 15; September 3, 5, 6 and 9; and, October 7, 8, 14, 15, 21, 22, 28, and 29, 2008 to conduct live racing and accept pari mutual wagers on those additional races.
 
All parties may be represented by counsel and will be allowed to present evidence; call and examine witnesses; and, present arguments to the Commission.
 
The Maine Harness Horsemen's Association, the Maine Association of Agricultural Fairs, the Maine Standardbred Breeders and Owners Association, the Downeast Harness Horsemen's Association and the Department of Agriculture, Food and Rural Resources have automatic intervention status. Other persons desiring to intervene may apply by filing a request to intervene with the Commission in accordance with 5 M.R.S.A. § 9054 and Commission rule, Chapter 21, Section 7. Applications for intervention will be accepted until the commencement of the hearing.
