Approve Minutes:  January 24, 2007 Meeting

 

Adjudicatory Hearings:

1.      In re: Shawn Thayer (License No. 12300) – To review and take action on consent agreement between Shawn Thayer and the Commission. An analysis of blood sample #03234 taken from Vandaminator on December 16, 2006 after the sixth race at Scarborough Downs disclosed an elevated blood gas lever (TCO2), which is a positive test pursuant to Chapter 11 in the rules established by the Maine Harness Racing Commission. Mr. Thayer is the trainer of record for Vandaminator. The owner is Joseph Trice.

 

2.      In re: Aaron Tuttle (License No. 11963) – To determine what action the Commission wishes to take concerning Aaron Tuttle who had appealed his positive test findings of Naproxen on July 29, 2006. This matter has been continued twice prior to this meeting.

 

3.      In re: Richard Robertson, Jr. (License No. 11561) – It is alleged that the analysis of blood sample  #3032 taken from the horse, Da Bone Man, at Scarborough Downs on December 10, 2006 prior to the second races disclosed an elevated blood gas level (TCO2) which is a positive test pursuant to Chapter 11 in the Commission’s Rules. Da Bone Man finished first in the second race. Mr Robertson is the trainer of record for Da Bone Man. The owners of Da Bone Man are Ricard Robertson, Jr. and Richard Loubier. Mr. Robertson is represented by William Childs, Esq.

 

Unfinished Business:

1.      In re: Robert H. Harvey (License No. 12170) – To review and take action on a consent agreement between Robert Harvey and the commission. An analysis of urine sample #02486 taken from the horse, Everything OK N, at Bangor Raceway on July 9, 2006 after the tenth race disclosed the presence of Phenylbutazone and metabolites, a Class 4 Drug, which is a positive test pursuant to Chapter 11 in the Commission’s rules. Mr. Harvey is the trainer of record for Everything OK N. The owner of record for Everything OK N is Lawrence L. Nichols of Lake Worth, Florida.


New Business:

1.      To appoint the list of Judges for 2007 pursuant to Chapter 3, Section 1

2.      A request from Omer Burke, Sr. to allow the Amateur Drivers a blanket license for a limited number of drives. A series of races is held each year throughout the Eastern United States.

3.      Commissioner Kuklinski wishes to discuss a possible rule change requiring track management to withhold a portion of the purse for the winning drivers.

Reports:

1.      Update from Presque Isle Fair on their proposal for an extended meet as required by the Race Date Decision of 2007.
