Hearings:
1.
In re: Richard Robertson, Jr. (License No. 11561)
– It is alleged that the analysis of blood sample #3032 taken from the horse, Da Bone Man,
at Scarborough Downs on December 10, 2006 prior to the second races disclosed
an elevated blood gas level (TCO2) which is a positive test pursuant to Chapter
11 in the Commission’s Rules. Da Bone Man finished first in the second
race. Mr. Robertson is the trainer of record for Da Bone
2.
In re: Pursuant to Title 8 MRSA Section 271
subsection 7: “Prior to August of each year, the commission shall conduct
a hearing to determine whether the horse supply in the State has been adequate
for the number of dashes conducted on assigned race dates. If the commission
concludes that the horse supply has been inadequate, the commission shall limit
to the extent necessary the number of dashes that a licensee may race on any
date after August 1st of that year that has been assigned to more
that one track. The commission may not restrict the number of dashes to fewer
than ten.”
Unfinished Business:
1. Update from Northern Maine Fair on their proposal for an extended meet as required by the Race Date Decision of 2007. The letter provided by Norman Trask, Esq. was determined to be contradictory regarding which, if any, of the dates awarded to Northern Maine Fair’s Extended Meet are to be used.
New Business:
1. In re: Brent Thayer – To review and take action on consent agreement between Brent Thayer (License No. 10994) and the commission. An analysis of blood sample #24103 taken from Vandaminator on May 28, 2007 after the ninth race at Scarborough Downs disclosed an elevated blood gas level (TCO2), which is a positive test pursuant to Chapter 11 in the rules established by the Maine Harness Racing Commission. Mr. Thayer is the trainer of record for Vandaminator. The owner is Joseph Trice.
2. In re: Robert Marston – To review and take action on consent agreement between Robert Marston (License No. 17872) and the Commission. An analysis of blood sample #5898 taken from Golden Sunflower on June 10, 2007 after the fourth race at Scarborough Downs disclosed an elevated blood gas level (TCO2), which is a positive test pursuant to Chapter 11 in the rules established by the Maine Harness Racing Commission. Mr. Marston is the trainer of record for Golden Sunflower. The owner is Bruce Bridgham.
3. In re: Loyal Pratt – To review and take action on consent agreement between Loyal Pratt (License No. 18204) and the Commission. An analysis of urine sample #05519 taken from Gold Ball on May 6, 2007 after the tenth race at Scarborough Downs disclosed the presence of Guaifenesin, a Class IV Drug, which is a positive test pursuant to Chapter 11 in the rules established by the Maine Harness Racing Commission. Mr. Pratt is the trainer of record for Gold Ball. The owner is Robert Larkin.
4. The Maine Harness Horsemen’s Association has requested the Commission provide a clarification of the claiming rule affiliated with allowances on fillies and mare’s races, Commission Rule Chapter 7 Section 17 subsection 7. The executive director has interpreted the rule to mean that allowances may only be given to mares if sexes are mixed in a claiming race. Past practice has been to provide for allowances in claiming races for fillies and mares.

1. The executive director will give a legislative update on initiatives that were adopted during the First Regular Session of the 123rd Legislature.
